Currently, most psychedelic substances remain classified as Schedule I drugs under federal law, making their use, possession, and distribution federally illegal in the United States. This classification includes substances such as psilocybin, MDMA, and LSD. As a result, psychedelic-assisted therapy is not currently legal at the federal level.

  1. Oregon Psilocybin Services: In 2020, Oregon became the first state to legalize psilocybin for supported adult use. As of 2023, adults 21 and older can access psilocybin services at licensed service centers under the guidance of a trained facilitator. While this is not therapy, it does provide a legal avenue for psilocybin use.   2. Ketamine Clinics: Ketamine, while not a classic psychedelic, is legally used off-label for depression treatment in clinics across the country.

  4. Other State Programs: Colorado has also passed a program similar to Oregon that makes psilocybin legal at the state level and available to the public via licensed healing centers. Still other states are in various stages of legislation to adopt similar measures.
